With year one of the Biden Administration’s term in the history books, we have a clearer sense of how the U.S. Environmental Protection Agency (EPA) is proceeding on all fronts. EPA’s Office of Pesticide Programs (OPP) is focusing on long-standing challenges, especially a renewed effort to meet Endangered Species Act (ESA) consultation requirements and determining how best to meet core pesticide registration review obligations in 2022. These program priorities must reflect special considerations for environmental justice and climate change, advance critical science and policy issues, develop a fifth Pesticide Registration Improvement Act (PRIA) implementation framework, and display a renewed commitment to working collaboratively with state partners and other stakeholders to implement the program.

"Understanding Pesticide Regulation and the 9th circuit Dicamba Decision," presented by the American Agricultural Law Association (AALA), provided an overview of pesticide regulation and registrations in the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the recent amended registrations for over-the-top (OTT) uses of dicamba, and the potential impacts of the recent 9th Circuit Court of Appeals decision in National Family Farm Coalition v. WEBINAR—Sustainable Investment in Agriculture, May 22, 2019, 12:00 pm EDT

The IBA Agricultural Law Section, supported by the ABA Section of Environment Energy and Resources, Committee on Pesticides, Chemical Regulation and Right-to-Know, the Environmental Law Institute and the National Agricultural Law Center, presented “Sustainable Investment in Agriculture,” with a focus on emerging legal issues in the area of sustainable and responsible investment in agriculture. Presenters discussed emerging tools and legal models for ensuring sustainable investment in agriculture, with a focus on the UNIDROIT initiative; due diligence for proposed investments; financial instruments; and where we go from here. WEBINAR - - Chemical Regulation After the Mid-Terms: What We Can Expect to See in 2019, February 20, 2019

(B&C®) and Bloomberg BNA were pleased to present “Chemical Regulation After the Mid-Terms: What We Can Expect to See in 2019,” the fifth and final webinar in the 2018 Chemical Policy Summit Series. The mid-term elections fundamentally changed the balance of power on Capitol Hill, and the result will have a significant impact on chemical regulation and environmental matters generally.  The Democrats are now firmly in control of the House, and Congressional oversight will be in high gear.  The House is widely expected to launch a dizzying number of investigations, almost certainly some of them related to the U.S. Environmental Protection Agency’s (EPA) positions on climate change, the role of science, ethical lapses, and deregulation in general.  The use of subpoenas is also expected to be in full display this year.  House and Senate leadership in key Committee assignments will change and so also will the personalities, tone, and content of Congressional oversight of and priority setting related to chemical and other environmental matters.  Speakers Alexandra Dapolito Dunn, Assistant Administrator, U.S. Environmental Protection Agency (EPA) Office of Chemical Safety and Pollution Prevention; Beau Greenwood, Executive Vice President, Government Affairs, CropLife America; Lynn L. ELI Summer School Series 2018: Law & Policy of Products Regulation, July 24, 2018, Washington, D.C. and via Webinar

The life cycle of industrial, agricultural, and antimicrobial chemical products, especially those embedded in consumer products, has gained increasing public attention. Regulators are beginning to look at the entire product life cycle, including after the discard of a product at the end of its useful life, not just toxicity data. Lynn L. Bergeson, President, The Acta Group (Acta®), presented Law & Policy of Products Regulation, examining the regulation of chemicals that are used in industrial and consumer products, as well as pesticides, and describing the new governance and stewardship initiatives being considered globally by a wide variety of stakeholders to diminish the potential for adverse effects from chemicals. A complimentary recording of this presentation is available on ELI's website.
